MEMBERS PROGRAM — TERMS OF USE

These Members Terms of Use (the “Terms”) govern participation in the Bomber LD Inc. membership program (the “Program”) offered by:
Bomber LD Inc. Inc., a Canadian corporation (“Company,” “we,” “us,” or “our”).
By enrolling in or participating in the Program, you agree to these Terms and the Company’s:
• Terms of Service
• Privacy Policy
• Shipping Policy
• Return Policy
If you do not agree, you may not participate in the Program.
1. ELIGIBILITY
To enroll, you must:
• Be the age of majority in your province or territory
• Provide accurate and complete account information
• Maintain an active customer account on bomberld.ca
The Program is intended for customers located in Canada, excluding Québec (see Section 14).
2. FREE MEMBERSHIP\
The Program is offered free of charge.
• No membership fees
• No recurring billing
• No payment required to join
Bomber LD Inc. may introduce paid tiers or premium features in the future.
3. MARKETING COMMUNICATIONS (CONDITION OF MEMBERSHIP)
Participation in the Program requires consent to receive marketing and promotional communications from Bomber LD Inc.
Members may withdraw consent at any time; however, such withdrawal will result in the loss of membership benefits. The underlying customer account will remain active.
Bomber LD Inc. reserves the right to condition Program eligibility on ongoing communication consent, to the extent permitted by applicable law.
4. CANADA ANTI-SPAM COMPLIANCE (CASL)
Bomber LD Inc. sends commercial electronic messages in compliance with Canada’s Anti-Spam Legislation (CASL).
• You may withdraw consent at any time using unsubscribe mechanisms included in communications
• Withdrawal of consent will be processed without delay
Nothing in these Terms limits your rights under CASL.
5. MEMBERSHIP BENEFITS
Members may receive access to benefits including:
• Free standard shipping (subject to thresholds and regional eligibility)
• Free returns (where offered)
• Early access to product releases and restocks
• Exclusive products, pricing, or promotions
• Priority customer support
Benefits:
• Are not guaranteed
• May vary by region
• May be limited by inventory, logistics, or operational constraints
Bomber LD Inc. Inc. may modify or discontinue benefits at any time.
6. SHIPPING & RETURNS BENEFITS
Membership-related shipping and return benefits are subject to:
• The Bomber LD Inc. Inc. Shipping Policy
• The Bomber LD Inc. Inc. Return Policy
Key Limitations
• Free shipping applies only to qualifying Canadian orders that meet the minimum order value threshold.
• Free shipping excluded in Canadian territories
• Returns must meet all eligibility requirements
Membership does not override core policy conditions.
7. ACCOUNT RESPONSIBILITY
You are responsible for:
• Maintaining the confidentiality of your account
• All activity under your account
• Ensuring account information is accurate
Bomber LD Inc. Inc. is not liable for unauthorized account use.
8. PROHIBITED USE
You may not:
• Abuse or exploit membership benefits
• Engage in excessive or fraudulent returns
• Circumvent geographic or policy restrictions
• Use automated systems or bots
• Manipulate promotions or pricing
Violation may result in suspension or termination.
9. TERMINATION & SUSPENSION
Bomber LD Inc. Inc. may:
• Suspend or terminate membership
• Revoke benefits at any time
• Cancel associated orders where necessary
Grounds include:
• Fraud or abuse
• Violation of these Terms
• Operational or legal risk
10. MODIFICATIONS TO PROGRAM
Bomber LD Inc. may:
• Modify or discontinue the Program
• Change eligibility, structure, or benefits
• Introduce new membership tiers
Continued participation constitutes acceptance of updates.
11. NO WARRANTIES
The Program is provided on an:
• “AS IS”
• “AS AVAILABLE”
basis without warranties of any kind, to the extent permitted by law.
12. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable Canadian law:
Bomber LD Inc. shall not be liable for:
• Indirect, incidental, or consequential damages
• Loss of profits, data, or goodwill
• Service interruptions or benefit unavailability
Total liability shall not exceed $100 CAD.
13. QUÉBEC NOTICE AND RESTRICTION
The Program is not offered to residents of Québec.
If a Québec resident enrolls or accesses the Program:
• Certain provisions of these Terms may not apply
• Rights under Québec consumer protection laws may prevail
• Bomber LD Inc. reserves the right to restrict, modify, or terminate access
14. PRIVACY
Participation in the Program is subject to the Privacy Policy.
Personal information is collected and used for:
• Membership administration
• Order fulfillment
• Marketing and personalization
15. GOVERNING LAW
These Terms are governed by the laws of the Province of Alberta and the applicable laws of Canada.
Any disputes shall be resolved in the courts of Alberta.
16. ENTIRE AGREEMENT
These Terms constitute the entire agreement regarding the Program.
17. SEVERABILITY
If any provision is found unenforceable, the remaining provisions remain in full force.
